Resolution N. 456-19 CONATEL-2000 of 5th October,2000,
as published in Official Gazette No. 201 of 10th November
2000, the National Telecommunications Council -CONATEL,
decided to set forth maximum rates for services regarding:
local, regional and international fixed telephony; local,
regional, national public telephone services; cellular
phones, according to the following details:

RULES
FOR THE GENERAL APPLICATION OF TELEPHONE TARIFFS as:
- Payment
of registration rights shall be effected at the time
the services contract is signed pursuant to the terms
and conditions therein set forth.
- In
the event a client does not pay the corresponding
bills, the operator may prevent this user from making
calls but cannot prevent the user from receiving calls.
Three months of delinquent payment will entitle the
carrier to end the contract for the provision of services.
- If
the service contract is terminated within the initial
five years after it has been signed, the carrier shall
return the user forty per cent (40%) of the registration
fee in effect on the date of contract termination.
If the contract was ended after the fifth year, the
client user shall not be entitled to reimbursement.
- In
the event services are interrupted during a period
exceeding ten (10) calendar days in one month due
to reasons other than force majeure, the user is entitled
to a compensation in the terms of a prorated credit
that is based on the average billings for that user
throughout the previous six (6) months, incorporated
into the first billing immediately after the interruption
took place.
- Local
calls shall be construed to be those that take place
within one same city. In the case of Quito, the city
will include the telephone central offices located
at: Calderón, Carapungo, San Antonio de Pichincha,
Pomasqui, Calacalí, Cumbayá, Tumbaco, Sangolquí, Conocoto
and San Rafael; for Guayaquil, the central offices
at: Durán, Primavera de Durán, Puntilla, Orquídeas
(Pascuales), Lago de Capeira and Chongón.
- Those
geographical areas included in the concession granted
to the following firms shall be defined as regions:
ANDINATEL S.A., PACIFICTEL S.A. and ETAPA. A regional
long-distance call is that taking place within one
same region; national long-distance call is that which
takes place between two regions; an international
long-distance call will correspond to a call originating
in Ecuador and ending in another country, or vice-versa.
- Category
A, i.e. popular rate, will correspond
to residential users whenever their six-month consumption
is less than 3000 minutes of local use (or the equivalent
in other type of use identified).
- Marginal:
Users located in urban areas where the average level
of poverty corresponds to 60% or more according
to the publication entitled La Geografía
de la Pobreza en el Ecuador (The Geography
of Poverty in Ecuador) published by Secretaría
Técnica del Frente Social (the Technical
Social Secretariat).
- Rural:
Users connected to central or remote units having
less than 1000 users and that are located in urban
centers having less than 17000 inhabitants.
- Oriental:
Users located in the Amazon Region.
- Galapagos:
Users located in the province of Galapagos.
- Borderline:
Users located in the borderline districts of Ecuador.
All users will be subject
to reclassification every six months and will be reverted
either to category "A or B,
in both directions, depending on their own level of
six-month consumption.
7. Telephone
services shall be identified as category B,
whenever the residential units housing one or more families
have up to three lines per housing unit, public sector
entities, Army offices, sectional administration (municipalities,
provincial councils), colleges and public education
schools and religious institutions.
8. Telephone
services that do not belong to neither of the above
categories "A" and "B" shall be
classified as category C".
8.
Billing shall be made pursuant to the legal provisions
currently in effect.
